Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and JobStack ("JobStack," "we," "us," or "our") and govern your access to and use of the JobStack website at jobstackcrm.com, our application at my.jobstackcrm.com, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Accounts
You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information and to keep that information up to date. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us promptly at hello@jobstackcrm.com if you suspect unauthorized access.
You may use the Service only for lawful business purposes and only as authorized by these Terms and by your employer or principal (if you are accessing the Service on behalf of an organization, you represent that you have authority to bind that organization).
2. Subscription, billing, and renewal
Access to most features requires a paid subscription. Subscriptions are billed in advance on a monthly basis (or any other interval you select at signup) at the price stated when you subscribe. Unless you cancel, your subscription will automatically renew at the end of each billing cycle and your payment method will be charged the then-current price.
Payment processing. Payments are processed by our third-party processor (currently Stripe). By providing payment information, you authorize us and the processor to charge your payment method for subscription fees, transaction fees, and any other amounts you owe.
Taxes. Stated prices do not include taxes. You are responsible for any sales, use, value-added, or similar taxes associated with your subscription, except for taxes based on JobStack's net income.
Refunds. Subscription fees are non-refundable except where required by law or expressly stated by us. If we make a material adverse change to the Service mid-cycle, we may, in our discretion, offer a pro-rata refund.
Cancellation. You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing cycle; you retain access until then.
3. Customer Data and ownership
You retain all rights to the data you submit to the Service, including information about your customers, jobs, invoices, estimates, photos, voice notes, and any other content ("Customer Data"). You grant JobStack a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Customer Data solely to provide the Service to you, secure it, and improve the Service. We may use de-identified or aggregated data for analytics and product development.
You represent and warrant that you have all rights, consents, and permissions necessary to upload Customer Data to the Service and to instruct us to use it in the ways the Service supports — including sending messages, estimates, and invoices to the end customers identified in that data.
4. AI features
The Service includes AI-powered features such as auto-responses, voice-to-estimate, follow-up drafting, and scheduling suggestions ("AI Features"). AI Features generate output based on inputs you provide and may produce errors, omissions, or inaccurate results. You are responsible for reviewing AI-generated content before relying on it, sending it to your customers, or treating it as a binding commitment, estimate, or invoice. JobStack does not warrant the accuracy of AI output.
AI inputs and outputs may be processed by third-party AI providers as described in our Privacy Policy. You agree not to submit content to AI Features that violates applicable law, infringes third-party rights, or includes regulated data we have not approved for processing.
5. SMS, email, and other outbound communications
The Service lets you send appointment confirmations, reminders, invoices, follow-ups, and other communications to your customers via SMS, email, voice, and other channels. You are solely responsible for ensuring that each recipient has provided the consent required by applicable law — including the U.S. Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state and federal SMS rules, and any analogous foreign laws — and for honoring opt-out requests promptly.
You agree not to use the Service to send unsolicited messages, harassing or threatening content, spam, deceptive or fraudulent communications, or any communication that violates any law or third-party right. JobStack may suspend or terminate sending privileges, accounts, or specific campaigns at any time if we believe such use is occurring.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Upload or transmit malware, viruses, or any harmful code.
- Attempt to interfere with, disable, or circumvent the Service's security, rate limits, or access controls.
- Reverse-engineer, decompile, or scrape the Service except as permitted by applicable law.
- Resell, rent, or sublicense the Service without our written consent.
- Use the Service to build a competing product or to benchmark it without our written consent.
- Impersonate another person or misrepresent your affiliation with anyone.
- Submit personal data or regulated data (for example, health, financial, or government-issued identifiers) that you do not have a lawful basis to process.
7. Third-party services and integrations
The Service may integrate with third-party tools such as Stripe, QuickBooks, calendar providers, telephony providers, and lead sources. Your use of those services is governed by their own terms and privacy policies. JobStack is not responsible for third-party services and provides no warranty over them. You authorize JobStack to exchange data with third-party services as needed to operate the integrations you enable.
8. Feedback
If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
9. Suspension and termination
We may suspend or terminate your account or access to the Service, with or without notice, if we believe you have violated these Terms, if your account is past due, if continued access poses a risk to other users or to JobStack, or if required by law.
On termination, your right to use the Service ends immediately. You may export Customer Data for a reasonable period after termination; thereafter we may delete it. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, JOBSTACK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. AI OUTPUT IS PROVIDED FOR YOUR REVIEW AND DOES NOT REPLACE PROFESSIONAL JUDGMENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOBSTACK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF JOBSTACK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ALL EVENTS, JOBSTACK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO JOBSTACK FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
12. Indemnification
You agree to defend, indemnify, and hold harmless JobStack and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Customer Data you submit; (c) communications you send through the Service; (d) your violation of these Terms or any applicable law; or (e) your infringement of any third-party right.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts. Each party waives the right to a jury trial to the extent permitted by law.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.
15. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, are the entire agreement between you and JobStack concerning the Service.
- Severability. If any provision is held unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
- No waiver. Our failure to enforce any provision is not a waiver of the right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Notices. We may give notice to you by email, through the Service, or by posting on jobstackcrm.com. Notices to us should be sent to hello@jobstackcrm.com.
