These SMS Messaging Terms of Service ("Messaging Terms") govern the text messages that Sparkle Technologies LLC, doing business as JobStack ("JobStack," "we," "us," or "our"), sends to you on behalf of the trade business you hired — the electrician, plumber, handyman, lawn care company, or similar contractor that runs its scheduling and billing on JobStack (the "Business"). By opting in to receive text messages, you agree to these Messaging Terms.

These Messaging Terms are for customers of businesses that use JobStack. If you are a contractor with a JobStack account, your agreement with us is the JobStack Terms of Service, and these Messaging Terms describe the program your customers are enrolled in.

1. Program name and description

The program is JobStack Customer Notifications. It is a transactional, customer-care messaging program. Once you opt in, you may receive text messages about a job you booked with the Business, limited to:

  • Appointment reminders. Confirmations when a visit is booked, a reminder the day before, and a heads-up when the technician is on the way or running late.
  • Estimates and quotes. A link to review an estimate the business prepared for you, and a note when that estimate is updated or about to expire.
  • Invoices and receipts. A link to view and pay an invoice, a receipt once payment clears, and a reminder if an invoice goes past due.
  • Replies about your job. Answers when you text the business back with a question about scheduling, an estimate, or an invoice.

We do not send marketing or promotional text messages through this program. You will not receive advertisements, offers, surveys, or messages from any third party as a result of opting in.

2. Who is texting you

Messages are sent by JobStack as the messaging provider, on behalf of and at the direction of the Business you hired. Each message identifies the Business. Messages come from the JobStack messaging number that contacted you. The Business decides which messages are sent to you and when; JobStack transmits them and maintains the opt-in and opt-out records.

3. How you opt in

We send messages only to numbers for which consent has been recorded. Consent is collected in one of the ways described on our Text Message Consent page: you give the Business your mobile number and agree to be texted, you check a separate, unchecked consent box on a quote request, estimate, or service agreement, you text the Business first, or you complete the consent form on our site and confirm from your handset.

Consent is not a condition of purchase. You do not have to agree to text messages to book a job, receive an estimate, or pay an invoice. If you would rather be contacted by phone or email, tell the Business and they will reach you that way.

By opting in, you represent that you are at least 18 years old and that you are the subscriber of the mobile number you provide, or that you are authorized by the subscriber to opt that number in.

4. Message frequency

Message frequency varies and depends on your job. Most customers get between 2 and 8 messages per job — typically a booking confirmation, a reminder before the visit, an estimate, and an invoice.

5. Cost

JobStack does not charge you for these messages. Message and data rates may apply. Message and data charges are set by your mobile carrier and are your responsibility. Contact your carrier for details about your plan.

6. How to stop messages

You can cancel at any time. Reply STOP to any message from the program. We also honor STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT.

After you send one of those keywords, we send a single confirmation message and then stop. The confirmation reads: "You have been unsubscribed from JobStack messages for this business and will receive no further texts. Reply START to resubscribe."

Opting out stops the text messages for the Business you opted in to. If you have hired more than one business that uses JobStack, opting out of one does not opt you out of the others — reply STOP to each. You can also ask the Business directly to remove your number, or email us at hello@jobstackcrm.com. Opting out of texts does not cancel your job or your obligation to pay an invoice; the Business will simply contact you another way.

To start again after opting out, reply START to the same number, or opt in again through the consent page.

7. How to get help

Reply HELP or INFO to any message and we reply with program information and a support contact: "JobStack: appointment, estimate, and invoice alerts from the business you hired. Msg&data rates may apply. Msg frequency varies. Help: hello@jobstackcrm.com. Reply STOP to cancel."

You can also email hello@jobstackcrm.com at any time. For questions about your job, your estimate, or your bill, contact the Business directly — they hold those records and we act on their instructions.

8. Supported carriers and carrier disclaimer

The program is available on major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, Cricket, MetroPCS, Virgin Mobile, and many regional and reseller carriers. Carrier support can change without notice, and some carriers may not support the program.

Wireless carriers are not liable for delayed or undelivered messages. Neither JobStack nor the Business guarantees that any message will be delivered, delivered on time, or delivered to the correct handset. Message delivery depends on your carrier, your device, and network conditions outside our control. Do not rely solely on a text message for time-sensitive or safety-related matters — confirm directly with the Business.

9. Changing or transferring your mobile number

If you give up, change, or transfer your mobile number, tell the Business or email us at hello@jobstackcrm.com so we can update or remove it. You agree to notify us promptly, and you agree that you are responsible for messages sent to a number you opted in but no longer use until you tell us. We may also remove a number if we learn it has been reassigned.

10. Your privacy

Our Privacy Policy explains what we collect and how we handle it. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party. We share your mobile number only with the Business you hired and with the vendors that carry the message (our telecommunications provider and your carrier), and only to deliver the messages you asked for.

Do not send sensitive information by text. SMS is not an encrypted channel. Never send payment card numbers, bank account details, Social Security numbers, or passwords by text — we will never ask you for them that way, and a message that does is not from us.

11. Consent record and retention

We keep a record of your opt-in — the date and time, the mobile number, the method of consent, and the exact wording you agreed to — together with any opt-out, for as long as we message you and for at least four years afterward. You or the Business can request a copy at hello@jobstackcrm.com.

12. Prohibited use

Do not use the messaging channel to send unlawful, abusive, harassing, or threatening content. We may block a number from the program at our discretion, including for abuse of the channel or at the Business's request.

13. Changes to these Messaging Terms

We may update these Messaging Terms. When we make a material change to the program — for example, adding a category of message — we will update this page and, where required, ask you to opt in again. The "Effective" date at the top reflects the current version. Continuing to receive messages after an update means you accept it; if you do not, reply STOP.

14. Disputes and governing law

These Messaging Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of the messaging program will be brought exclusively in the state or federal courts located in Collin County, Texas.
